Terms and Conditions


1.      Legal Agreement

These terms of use (“Terms”) constitute a legal agreement between you and Sport Strength Company Limited (“Company”, “we”, or “us”) and apply to the services provided on the Company’s website at www.primalperformancelab.com and mobile applications (collectively referred to as the “Platform”). By finishing the payment process, you agree to these Terms.

 

2. Membership Understanding and Agreement

·      The member has been advised and fully understands the benefits of the membership, the company's internal regulations, and the terms and conditions after making the payments

·      By making the payments, the member agrees to and is bound by all the terms and conditions, the appendices, and other internal regulations of the company that are in effect.

 

3. Membership Validity

Membership is valid from the start date specified in the booking app or the paid date and end on the expiration date indicated in the Primal booking app.

 

4. Adjustments to Services

Primal reserves the right to adjust service prices and applicable conditions.

 

5. Class Schedule and Operating Hours

Primal reserves the right to change the class schedule and operating hours of the club. Any changes will be communicated to the members as soon as possible to ensure their rights and convenience.

 

6. Compliance with Regulations

The member agrees to comply with all company regulations regarding the use of services and equipment. The member is responsible for their own safety when using the club's equipment and services. Primal is not liable for any damage or injury arising from improper use.

 

7. Privacy and Data Use

·      Primal is committed to protecting the privacy and confidentiality of the member's personal information. Any personal information collected from the member will be used for the purpose of providing services and customer care. Primal will not share the member's personal information with third parties without the member's consent, except as required by law.

·      The member agrees to allow Primal to use their images and videos in Primal's promotional and marketing activities without requiring any additional payment or consent.

 

8. Non-Solicitation Clause

As a member of Primal, I agree not to solicit, hire, or attempt to hire any Primal staff or recruit other members for private training or business purposes during my membership. Violations may result in membership suspension or termination without refund and potential legal action to protect Primal’s interests.

 

9. Periodic Updates

Our terms and conditions will be updated periodically and posted on our website. We will refer to the terms and conditions on our website as the most up-to-date version. By finishing the payment process, members agree to abide by the latest terms and conditions as posted on our website.

 

10. Non-Refundable Contract

All the payments that have been made are non-refundable.

 

11. Account and Password

Users are responsible for maintaining the confidentiality of their account credentials. If you detect unauthorized access, you must notify the Company immediately. You are granted a limited, personal, non-exclusive, non-transferable license to use the Primal website and booking application, subject to compliance with these Terms.

 

12. Medical Disclaimer

The information provided in the Primal system is for informational purposes only and does not replace professional medical advice, diagnosis, or treatment. Consult a physician before starting any exercise program, particularly if you have a history of health issues.

 

13. Promotions and Transactions

·      Promotions may have additional rules. By participating, you agree to those terms.

·      By making payments online or in person, you agree to provide accurate payment information and authorize the Company or its payment processor to charge applicable fees.

 

14. Third-Party Links

The Primal website and booking application may include links to third-party websites. The Company is not responsible for the content, accuracy, or services provided by these websites.

 

15. Intellectual Property

All content on the Primal website and booking applications, including text, graphics, logos, and designs, is owned by the Company or its licensors. Unauthorized use or reproduction is prohibited.

 

16. Limitation of Liability

The Company is not liable for any indirect, incidental, or consequential damages arising from the use of the Primal website and booking application.

 

LIABILITY WAIVER AGREEMENT

1.  General Introduction
This Liability Waiver Agreement applies to all activities, including but not limited to, training sessions, soaking pools, steam rooms, and ice baths (hereinafter referred to as "Activities") provided by Primal or any affiliated organization. This agreement also includes all partners, agents, contractors, trainers, including the President of Primal, program developers, and assistant trainers.

 

2.  Acknowledgment of Risks
I acknowledge that Activities at Primal may involve risks, including but not limited to physical injuries, muscle strain, injuries, or health emergencies. I recognize that soaking pools, steam rooms, and ice baths may cause effects such as dizziness, dehydration, overheating, or thermal shock. I understand that although safety measures are in place, unintended incidents may still occur.

 

3.  Voluntary Participation and Acceptance of Risks
I agree to participate in Activities at Primal voluntarily and accept full responsibility for any associated risks. I confirm that I am in good health and have the physical capability to engage in Activities and have consulted a doctor if necessary.

 

4.  Waiver of Liability
I agree to waive, release, and hold harmless Primal, its trainers, staff, agents, contractors, and any related parties from any injuries, damages, or losses occurring during participation in Activities. This includes both known and unknown risks, as well as situations arising from negligence (excluding gross negligence or intentional misconduct).

 

5.  Personal Responsibility and Compliance
I agree to comply with all rules and guidelines set by Primal related to the use of soaking pools, steam rooms, and ice baths. I commit to using the equipment and facilities safely and appropriately. I understand that non-compliance with these regulations may result in denial of services at Primal without refund.

 

6.  Personal Health Commitment
I confirm that I do not have any health conditions (including cardiovascular disease, high blood pressure, respiratory issues, or other medical conditions) that might be exacerbated by participating in Activities. I agree to inform Primal staff of any health issues or unusual symptoms during participation.

 

7.  Updates and Notification of Changes
I agree that Primal has the right to modify the terms and conditions of this Agreement at any time without prior notice. I will be responsible for regularly checking for updates. Continued participation in Activities after changes indicates acceptance of the revised terms.

 

8.  Emergency Situations and Support
I understand that in case of a medical emergency or accident, Primal may provide basic first aid support but is not obligated to provide comprehensive medical treatment or emergency transport. I agree that any costs related to medical treatment or emergency transportation will be my responsibility.

 

9.  Non-compliance with Service Regulations
I agree that using services in a manner not compliant with Primal’s regulations and guidelines may result in denial of service or claims for damages. I understand that Primal has the right to refuse service if I do not adhere to regulations or if my behavior is inconsistent with Primal's policies.

 

10.  Facility Conditions and Maintenance
I understand that Activities and equipment at Primal may require routine maintenance or repair. Primal is not responsible for any interruptions in service or activities due to maintenance or repair.
